Title Specific Distributions

Royalties distributed for reported use of your work.

Access Copyright will distribute royalties to rightsholders based on knowledge that a rightsholder's copyright protected work was copied under an Access Copyright licence. There are two types of title specific distributions:

  • Full reporting - Works reported by our licensees.*
  • Partial reporting - Works revealed in a survey of copying.

Full Reporting

In certain cases, licensees with reporting requirements must submit bibliographic information on the works they copy, including the number of pages they copy and the number of times each page is copied. Royalty payments are made to creators and/or publishers of the works appearing in these reports.

This full reporting method is used for the distribution of royalties from:

  • Colleges & universities (coursepack copying)
  • Businesses (distribution of hard copies to non-Full Time Equivalents (FTEs) and educational course package copying)
  • Non-profit Associations and Organizations (distribution of hard copies to non-Full Time Equivalents (FTEs) and educational course package copying)
  • Document delivery
  • Transactional licences (licences for the reproduction of pre-identified works for one time use)
  • Other Reproduction Rights Organizations (RRO's)

Partial Reporting

Royalties for copying done in primary and secondary schools are distributed based on surveys that are conducted in schools across Canada (excluding Quebec). These surveys are designed to provide a statistically relevant sample and are used to collect title-specific information on what works are copied.

The school distribution is a title specific distribution that is based on the results of a comprehensive photocopy study that Access Copyright commissioned in 2005 and 2006 and an updated study that was conducted in 295 schools in 2010. The institutions in the survey were selected randomly and the data collected is representative of all K-12 institutions in Canada outside of Quebec. The 2005/2006 school survey data represents 80% of the weight while 20% of the weight is assigned to the 2010 school survey data.

On June 27, 2009, the Copyright Board of Canada increased the tariff (royalty) rate for the photocopying of printed works in Canada's elementary and secondary schools (excluding Quebec) from $2.58 to $5.16 per student per year.  The Ministries of Education and Ontario school boards appealed that decision.  The Federal Court of Appeal ruled in favour of Access Copyright and found that the Copyright Board's decision was reasonable in light of the evidence before it. We are now waiting for a decision from the Supreme Court of Canada.  No distributions can be made from the increased royalties collected until all legal proceedings are completed.  Pending the outcome of all possible appeals, we continue to distribute the royalties based on the old rate of $2.58 per student.
